Moorabool Council has been given access to 18 technical reports related to Maddingley Brown Coal’s bid to sort and store contaminated soil from the Westgate Tunnel on the outskirts of Bacchus Marsh.

Council has been asking for the documents since 2019 and the State Government has given it three weeks to respond. Moorabool is also seeking access to any further reports including a Human Health and Environmental Risk Assessment.

MSC said Councillors had earlier voted to make these documents public and keep locals informed, but the proponent has written a legal letter to council saying it believes the documents should remain confidential due to commercial sensitivities.

Moorabool is seeking advice from Planning Minister Richard Wynne and investigating its options.

The Minister is also deciding if he will use his powers to take control of Council’s planning approvals process for this project.
